The US Supreme Court on Monday unanimously rejected Colorado’s attempt to exclude Donald Trump from the Republican presidential primary ballot, disputing allegations of his involvement in the January 6, 2021 insurrection.
While the Constitution prohibits individuals engaged in insurrection from holding office, Trump was neither charged nor convicted.
The unanimous decision emphasized that states lack the constitutional authority to enforce this provision, especially concerning the presidency, though they can apply it to state offices.
This ruling prevents any state from using the insurrection clause to bar Trump or any candidate from a presidential ballot. The decision, favoring Trump just ahead of Super Tuesday primaries, strengthens his bid for the party’s nomination for the third time.
The Colorado Supreme Court’s earlier 4-3 decision, based on disputed Democratic claims, was overturned by the unanimous Supreme Court verdict.
