Lagos, July 7, 2015 (NAN) An Igando Customary Court in Lagos on Tuesday dissolved 12-year old marriage between Mr Omotayo Ogunbode, 40, and his wife, Alaba, on alleged threat to his life.
The Court President, Mr Hakeem Oyekan, in his judgment, said that it was obvious from the available evidence and the respondent’s refusal to appear in court that the marriage had failed.
“Throughout the duration of this case, the respondent, Alaba, has refused to honour the court process by refusing to appear in court.
“Therefore, the court has no choice, but to dissolve the marriage between the couple.
“The couple can no longer stay together because the marriage has broken down totally, both parties are no longer husband and wife, they are free to go their separate ways,” Oyekan ruled.
The president said that the issue of custody of the children should be referred to the family court within the Lagos judicial division that had the right to determine children’s plight under the age of 18.

He ordered the petitioner to contribute N50, 000 for the rehabilitation cost.
The petitioner’s wife, had failed to appear in court after being summoned several times by the court.
“My wife wanted to kill me; she always stabbed me with sharp objects,’’ he said, describing her as a troublesome person.
“My wife always fight me in the house and she often comes to my office to fight me. On two occasions, she has written a letter to my company to sack me, alleging that I am an irresponsible man,” he said.
The petitioner recalled that he married Alaba because his first wife did not have a child, but she started misbehaving after she gave birth to two children.
