ABUJA (Sundiata Post) – The Federal High Court (FHC) sitting in Abuja, has adjourned ruling on the bail application filed by the Director of Radio Biafra, Nnamdi Kanu, to January 29.
At the assumed hearing on Monday, the presiding judge, Justice John Tsoho, settled to adjourn for a ruling on an application filed by the accused person on January 14, after hearing arguments from both the prosecuting and defence counsel.
Earlier, counsel to Kanu, E. M Ekweju, moved the motions for the bail on the premise that Section 158 and 162 of the Administration of Criminal Justice (ACJ) Act 2015, is a statutory right in the constitution for an accused person seeking for bail before the court.
“My lord, it is my humble submission that the counter affidavit filed by the prosecution has not attempted to meet the provisions of Section 162 of the CJA,” Ekweju said.
This application was however objected by the prosecuting counsel, Mohammed Diri, who said that the only material attached to the application is what has happened before the Magistrate Court.
Diri noted that no affidavit of means is included as claimed by the defence counsel.
He also said the oral application by the counsel does not tally with his affidavit.
Diri further prayed the court to refuse the applicant bail and an order for accelerated hearing.
After hearing the submissions and objections, Tsoho adjourned ruling on bail application to Friday, January 29.
The judge had on Wednesday, January 20 ordered that Kanu be remanded in Kuje prison pending hearing on his bail application on Monday, January 25.
Prior to the court’s directive, the embattled Coordinator of the Indigenous People of Biafra (IPOB) has been under the custody of the Department of State Security Service (DSS) since his arrest in October, 2015.
An action which one of his counsel, Chuks Muoma argued has left him incommunicado with his family and lawyers inclusive but sources have confirmed that Kanu’s family “now have access to him since he was moved to the prison facility and there have been visitations from his immediate family members”.

Similarly, Kanu for the first time since he was arrested by the DSS has had a change of cloth that he wore to the FHC on Monday.
The Biafran activist was brought in by officers of the Nigerian Prison in a blue and yellow native Ankara jumper, different from the “famous” sky blue shirt and and Chinos trouser he has always worn since his first arraignment at the Magistrate Court in Wuse, Abuja.
However, he was still unshaven.
“You will see him today, looking better than the last time, at least he had also eaten good food too,” a source has informed some journalists prior to his arrival to the court .
Kanu is being accused of unlawful possession of firearms and assisting in the management of an unlawful society among other charges.
