MARARABA – A Grade 1 Area Court in Aso Pada, Mararaba, Nasarawa State, on Wednesday struck out a criminal case against a couple, Mohammed and Ramatu Aliyu.
The couple was charged with one count of disturbance of public peace on Jan. 6.
They were alleged to have beaten their neighbour, Ms Gloria Benjamin.
The presiding judge, Mr Albert Maga, struck out the case after the prosecutor, PC Friday Adaji, told the court that all parties had agreed to settle out of court.
Maga therefore discharged the couple.
“Based on the reconciliation made by the complainant and the accused persons to live in peace with each other, the case is hereby struck out and the accused persons discharged.
“The accused persons should write an undertaking that they will not fight with their neighbour again but live in peace.”
He also admonished them never to be involved in similar acts, as the court would not take it lightly with then next time.
The prosecutor had told the court that on Jan. 1 at about 4.30 p.m., Benjamin of Kabayi, Zone 5 Mararaba, lodged a complaint against the couple at the `A’ Divisional Police Station.
Gloria alleged that on the same day, Mohammed and his wife beat her up during a misunderstanding.
The police said that the couple also assaulted the complainant.
According to the police, the offence contravenes section 113 of the Penal Code.
The accused had pleaded not guilty. (NAN)
