Abuja – An FCT High Court on Tuesday granted leave for medical attention to Dahiru Yusuf, the third defendant in a case of alleged criminal conspiracy and armed robbery.
Justice Peter Affen granted the application filed by Yusuf through his counsel, Mr Suleiman Danlami, on grounds that only a healthy person could stand trial.
Affen ruled that it was only a healthy person that could stand trial.
He said that although the prosecutor was not in court, but special exceptional circumstances could warrant granting of such application.
He said that the defendant provided enough evidence to grant such prayer, adding that he brought a letter from University of Abuja Teaching Hospital to explain the state of his health.
Affen ordered that the Kuje Prisons authority should release the defendant to seek medical attention outside the prisons’ hospital.
He then adjourned the matter to March 23 for trial.
The accused persons, Omenini Bayallah, 30, Paul Sunday (Smally), 20 and Dahiru Yusuf, 40, are all residing in Abuja.
They were arraigned on a three-count charge by the Police.
On the resumed hearing on Tuesday, the Prosecuting Counsel, Mr Kenneth Ubanwa, was absent, but had communicated to the court that he was going for verification outside Abuja.
On Nov. 17, the Prosecuting Counsel, Mr Kenneth Ubanwa, had informed the court that on July 14 at about 2.00 a.m the 1st and 2nd defendants conspired to commit robbery at Maitama, Abuja.
He said that they robbed one Mrs Ogechukwu Irono of Maitama, Abuja, of her Samsung Galaxy Note 3, 25, 000 US dollar cash, jewellery valued at N32 million and other personal items.
He said that these offences contravened the provisions of Section 6 of Armed Robbery and Firearms Act.
Ubanwa also told the court that the 3rd defendant on the same date received the stolen jewellery from the 2nd and the 3rd defendants
All the defendants took their plea and were later remanded in the prison.
