Benin – An Evboriaria Magistrates’ Court in Benin on Wednesday ordered the remand of a 39-year old man, Lucky Jerry, in prison custody, over the alleged murder of Aimuamwosa Otabor.
The Prosecutor, ASP Aigbedion Obakpolor, said that the accused committed the offence on May 19, 2013, at No. 21, Amadasun St., off Uwa St., in Benin.
Obakpolor alleged that the suspect, on the said day at about 8: 00 p.m., shot and killed Otabor with a single barrel gun.

The plea of the accused person was not taken on the two-count charge of conspiracy and murder.
The prosecutor said the offence contravened Sections 324 and 319 (1) of the Criminal Code, Cap. 48, Vol. 11, Laws of the defunct Bendel State of Nigeria, 1976, now applicable in Edo.
The Magistrate, Mr F.O. Idiake, who ordered that the accused to be remanded in prison custody, noted that the magistrates’ court lacked the jurisdiction to entertain the case.
Idiake further ordered the case file to be sent to the Office of the Director of Public Prosecutions, for advice.
He adjourned the case till Dec. 30 for mention. (NAN)
