Kaduna – A Sharia Court l sitting in Magajin Gari in Kaduna State on Wednesday stopped the hearing of a case bordering on alleged breach of trust.
The Judge, Muhammad Adam-Shehu, stopped the case and ordered the complainant to regard the authority of the Upper Sharia Court as documents were issued by the defendant and the case was earlier filed there.
Earlier, The Complainant, Sani Abdullahi of Tudun Wada, Kaduna, had filed the case in Sharia court, seeking to recover his N701, 000 from one Magaji Dangote of Bakin Dogo, Kaduna.
The complainant, Abdullahi, through his counsel, Nasir Abdullahi, told the court that the defendant had been issued with court sermons several times, but he had refused to appear before the court.
He, however, denied the knowledge of the document sent by the defendant claiming that he had filed a case regarding the matter in Upper Sharia Court, while the case was set for mention in the present court.
“It is against the law, he can only make appeal in Sharia Court of Appeal after the case is mentioned and judgment is reached.
“I am praying the court to charge him with contempt for disregarding this court summons,” the counsel said.
