Mararaba (Nasarawa State) – A Mararaba Grade 1 Area Court, Aso Pada, on Tuesday struck out a case of alleged assault filed against a 29-year-old tailor, Chukwuma Ezine.
The tailor, who resides at Guruku Mararaba, was arraigned on a five-count charge of criminal conspiracy, criminal trespass, assault, mischief and theft.
The Presiding Judge, Mr Albert Maga, struck out the case following a written application from both the complainant and the accused to settle the case out of court.
“The court is happy to grant your request as it is the prayer of everybody, the court included, that when there is any misunderstanding, the parties involved should try to settle it amicably.
“Where such attempts fail, instead of taking laws into individual hands, the court should be involved for the two parties to get justice,’’ he said.
Maga, however, said that the accused should write an undertaking that she would be of good behaviour.
He also admonished her never to be involved in a similar act as the court would not take it lightly with her next time.
The Prosecutor, Cpl. Friday Adaji, had told the court that on Dec. 23, Chinedu Matthew of same address with accused, reported the matter at the `A’ Division Police Station.
Adaji said the complainant was in his room after a misunderstanding with the accused over the N1,500 he borrowed from her but could not pay back.
He said the accused later mobilised four boys, now at large, trespassed into Matthew’s room, beat him up, destroyed his property worth N25,000 and stole his brother’s phone valued at N4,000.
The accused, however, denied the allegations.
The prosecutor said that the offences contravened Sections 97, 248, 265, 327 and 288 of the Penal Code. (NAN)
