Gwagwalada (FCT), – A Gwagwalada Chief Magistrates’ Court, FCT, on Wednesday struck out an assault charge against two civil servants, Osaretin Oduh and Emmanuel Akor for parties agreement to settle out of court.
Oduh and Akor were accused of assaulting the complainant, Mr Pius Kwado, resulting to injury on his left eye.
The defendants of University of Abuja Teaching Hospital Gwagwalada Abuja, was charged with criminal conspiracy, assault and causing hurt on July 26, 2019.
They pleaded not guilty to the charge.
The Chief Magistrate, Malam Munir Sani, struck out the charge following an oral application by the Prosecution Counsel, Abdullahi Tanko that the complainant approached him that the matter be withdrawn as both parties have settled their differences.
Sani consequently struck out the case and discharged the defendants.
Earlier, Tanko told the court that the complainant, Mr Pius Kwado of University of Abuja Teaching Hospital reported the matter at the Gwagwalada Police station on July 26, 2019.
He said that Oduh and Akor conspired and assaulted the complainant on his farm on April 16, 2019.
He said they injured the complainant on the left eye.
The prosecutor said that the offence contravened the Penal Code. (NAN)
