Ikeja – A 27-year-old fashion designer, Toheeb Razak, who allegedly hit his 64-year old landlord with a plastic chair, on Wednesday appeared in an Ikeja Magistrates Court.
The accused, who lives on N9 Olomowewe St., Mushin, Lagos, is charged with two counts of breach of peace and assault.
The prosecution alleged the accused conducted himself in a manner likely to cause a breach of peace by hitting one Theophilus Afolayan with a plastic chair, following an argument.
Police Insp Aondohemba Koti told the court that the accused committed the offence on Nov. 4 about 9. 30 a. m. at No. 9 Olomowewe St., Mushin in Lagos.
Koti said the accused, who pulled off the complainant’s daughter’s hair, also gave the complainant a fist blow on his left eye, following a disagreement.
“The wives of both the complainant and the accused were fighting.
“The complainant tried to separate them when the accused suddenly hit him with a plastic chair on his face,” he said.
The offences contravened Sections 168 and 173 of the Criminal Law of Lagos State 2015, (Revised)
The News Agency of Nigeria (NAN) reports that Section 173 provides three years imprisonment for assault while Section 168 stipulates six months jail term for breach of peace.
Chief Magistrate M. O. Tanimola admitted the accused to bail in the sum of N80, 000 with two sureties in like sum.
Tanimola ordered that the sureties must be gainfully employed with an evidence of two years tax payment to the Lagos State Government and have their addresses verified by the court.
She adjourned the case until Dec. 5 for mention.
