Abuja – The Federal High Court, Abuja, has ordered the Department of State Service (DSS) to produce one Peter Onuakhalu, in court on Sept.7.
Justice B.O. Quadri, gave the order following an application by Mr Solomon Ikongshul, counsel to Onuakhalu, for the enforcement of the fundamental human rights of his client.
Ikongshul told the court that his client had been in DSS custody since May.
He said that Justice Nnamdi Dimgba had made an order on Aug. 9 that Onuakhalu be produced in court, but the DSS disobeyed the order.
The lawyer told the court that his client was arrested on arrival in Nigeria over allegations of a crime he committed in the United States.
“They alleged that he was arrested by the American Government, tried, convicted and sentenced.
“On his arrival in Nigeria, he was arrested and there is nothing to show that he has committed any crime in Nigeria to warrant his arrest.
“So, I wonder whether American laws are now being applied to Nigerian laws.”
The DSS had previously argued that his detention was ordered by a competent court.
Justice Quadri adjourned the matter until Sept. 7 to hear the application of breach of fundamental human rights.(NAN)
