Abuja (Sundiata Post) – A legal practitioner in Jos, Barr. Lawrence Anyia has urged the Nigeria Judicial Council (NJC), to sanction the Judges who erred in the conflicting court orders as seen in the Kano State Emir-ship tussle, involving the dethroned Emir of Kano, Aminu Ado Bayero and Emir Muhammadu Sanusi II.
Describing the conflicting orders as unfortunate, Anyia also called it a relentless cacophony of judicial decisions that counter each other.
The Legal practitioner who spoke to our correspondent in Jos at the weekend, informed that in the past, the NJC had punished erring Judges who have found themselves issuing conflicting court orders.
“Judges have not come to terms with the orientation given by the NJC, even with all the conferences and seminars organized to guide them on constitutional law.
“Until the NJC comes down heavily on these Judges, we have not seen the last yet”, he said.
Anyia called out Justice Mohammed Liman of the Federal High Court in Kano for going against constitutional proceedings since he knew that chieftaincy matters are not for the thresholds of the Federal High Courts.
“This is a fact that has long been settled by the Supreme Court. So why will he in the first place take up an application brought before the federal high court that bothers on the chieftaincy institution.
“Knowing that there is no jurisdiction, he should have declined and ordered the parties to go to the appropriate judicial forum.
“So what is happening in Kano is a judicial aberration”, he said.
Recall that after Emir Sanusi ll was reinstated by Governor Abba Yusuf, a Federal High Court in Kano ordered his eviction from the Kofar Kudu Palace, while a State High Court restrained the police and other security agencies from carrying out the eviction order.
The Federal Court, had last Tuesday, ordered the police to ensure all rights and privileges due to the 15th Emir of Kano, Aminu Bayero, be given to him, as the rightful Emir of Kano.

When Justice Mohammed Liman of the Federal High Court in Kano Penultimate Thursday granted an ex-parte order stopping Governor Yusuf from reinstating Emir Sanusi II pending the determination of a substantive suit filed against the reinstatement, many Nigerians knew that the order would not be the only court order in the case.
