Benin – An Evboriaria Magistrates’ Court sitting in Benin on Monday remanded a 34-year old man, Fabian Enogieru, in prison custody for allegedly killing one Pallen Enogieru.
Enogieru, of no fixed address, is facing a charge of murder.
The Prosecutor, ASP. Aigbedion Obarkpolor, said that the accused committed the offence at No. 1, Amayo St., off Upper Sakponba in Benin on Oct. 8.
Obarkpolor said that the accused unlawfully inflicted injuries on the complainant by hitting him with a piece of wood on head.[pro_ad_display_adzone id=”70560″]
He said the offence contravened Section 319 (1) of the Criminal Code, Cap 48, Vol. 11, Law of defunct Bendel State of Nigeria, 1976, now applicable in Edo.
The plea of the accused was not taken.
The Magistrate, Mrs N.P. Edogun, said that the court lacked the jurisdiction to entertain the case.
Edogun said that the case file should be sent to the Director of Public Prosecutions (DPP) for advice and adjourned the case till Dec. 22 for mention.
