N6b Defamation Suit Against DG NIMASA: Court Adjournes Indefinitely


The six billion naira defamation suit filed by former Governor of Rivers state, Peter Odili, against the Director General of the Nigerian Maritime Administration and Safety Agency, NIMASA, Dakuku Peterside has been adjourned indefinitely.

Chief Judge of Rivers state, Justice Iyaye Lamikanra adjourned the matter because of a motion before the Appeal court over the ruling of the Chief Judge that bothers on the issue of house address earlier raised by Dakuku.

Dakuku Peterside had filed an application asking the court to dismiss the suit before it on grounds that the writ of summons was addressed to Number 1, First street, Forces Avenue, Old GRA and not Number 1, First Close, Forces Avenue, Old GRA where he resides.

Justice Lamikanra had in a ruling said the issue of address raised by Dakuku is not enough reason to dismiss the defamation suit.

Counsel to Peter Odili, Joseph Ogu said the matter at the appeal court will be disposed off before the main suit on defamation can continue.

“They have the right to go to the higher court if they are not comfortable with the ruling of a lower court. That is not a problem. Based on that, this court can no longer continue with the main matter on till the issue of address which they raised is addressed.

“We will have to suspend whatever we are doing here in the High Court while the Appeal court takes a decision.

“Time is of the essence but still, these are judicial processes that we must adhere to,” he said.
