Ikeja – A trader, Funmilayo Ogunleye, on Tuesday appeared before an Ikeja Magistrates’ Court in Lagos for allegedly obtaining N150,000 and failed to return it within the two months she promised.
Ogunleye, 46, who lives in Alagbado area of Lagos State, is being tried for obtaining money under false pretences and stealing.
The prosecutor, ASP Clifford Ogu, said the defendant committed the offences on Nov. 5, 2018 at Alagbado.
He said that the defendant fraudulently collected the money from the complainant, Mr Wasiu Yusuf, with the promise of paying him back within two months.
“After the defendant had collected the money from the complainant, she was nowhere to be found.
“Also, efforts made by the complainant to collect his money from the defendant proved unsuccessful as the defendant refused to pick calls made to his cell phone.
“The defendant was apprehended nine months after and handed over to the police,” the prosecutor said.
The prosecutor said that the offences contravened Sections 287 and 314 of the Criminal Laws of Lagos State, 2015.
The News Agency of Nigeria (NAN) reports that Section 287 prescribes three years’ jail term for stealing while Section 314 attracts 15 years for obtaining money under false pretences.
Following the defendant’s plea of not guilty, Magistrate J.A. Adegun granted her N100,000 bail with one surety in like sum.
Adegun said that the surety must be gainfully employed and show evidence of two years’ tax payment to the Lagos State Government LASG).
The court adjourned further hearing in the case for Sept. 12.
