Nigeria Customs Service.
Justice Danladi Umar, the Chairman of the Tribunal, sitting in Abuja, discharged the accused following an application of no case submission filed by his counsel, Mr Bob Jija.
The Attorney-General of the Federation (AGF) had filed the suit which alleged that the accused was fully involved in the running of Green Suit Villa Limited, a private company.
Ashigye was also accused of making false asset declaration since his shares and interest in the private [pro_ad_display_adzone id=”10″]company was not declared in his form.
Umar said the evidence provided by the prosecution was not enough to establish a prima facie case [pro_ad_display_adzone id=”10″][pro_ad_display_adzone id=”10″]linking the accused with the private company.
“Having considered the argument for and against the no case submission filed by the accused, it is clear that the prosecution had failed in its assignment.
“The prosecution has failed to prove beyond reasonable doubt that the accused was fully involved in the running of the private company.
“I therefore, uphold the application of no case submission and accordingly, discharge the accused,” he said.
Jija had faulted the suit on grounds that there was no evidence before the tribunal linking the accused with the alleged offence.
He urged the tribunal to uphold his application of no case submission and discharge his client. (NAN)
