Abuja – The National Industrial Court, Abuja, has ordered parties to maintain the status quo, in a leadership tussle suit instituted by the Road Transport Employers Association of Nigeria (RTEAN), against one Sunday Erhahon and eight others.
The other respondents are: Orobosa Aiguobarueghian, Lugard Edosah, Odion Isede, Imafidion Osahon, Sylvester Iyere, Cyril Ujiadughe, Abili Ogbe, and Monday Orhue.
The Association sued Sunday Erhahon, who was allegedly suspended as Edo State Chairman of RTEAN, asking the court to stop Erhahon from parading himself and other respondents as executives of Edo Chapter.
Erhahon was allegedly suspended by the national headquarters of the Association.
In a ruling on Thursday in Abuja, Justice Waziri Abali, held that the status quo be maintained by parties pending the hearing and determination of the motion on notice for interlocutory injunction currently pending in court.
The court also ordered that the respondents be put on notice immediately.
“I have perused the motion exparte, the affidavit in support as well as affidavit of urgency filed; I have equally read the written address.
“Paragraph three of the affidavit of urgency in support of the motion exparte, and exhibits attached convinced me that the defendants/ respondents should be put on notice at once,” Abali held.
Abali also ordered parties not to engage in or indulge in any action or inaction overtly or covertly that might lead to breach of peace, pending the hearing and determination of the motion on notice.
The Judge also ordered the return of the case file to the President of the National Industrial Court of Nigeria, since his assignment as a vacation judge ends on Sept. 8. (NAN)
