Zuba(FCT) – Drama ensued in a Zuba Grade 1 Area Court on Thursday as 32-year-old, Ebere Udoh, who was supposed to get his sentence, suddenly appeared in court with a counsel to defend her.
Udoh had pleaded guilty to a one-count charge of negligent conduct, which contravened Section 196 of the Penal Code.
The Judge, Malam Gambo Garba had reserved sentence till Thursday, Jan. 7, 2016.
Her lawyer, Mr Jacob Jikwe, at the resumed hearing on Thursday, argued that the court had no jurisdiction to entertain the mater.
Jikwe contended that Section 106(a) of the Administration of Criminal Justice Act 2015 ousted the powers of police officer to prosecute such matter.
The prosecutor, Insp. Haruna Danlami, opposed his application, arguing that Section 381(a)(b) and Section 112 (6) (f) of ACJA empowers police officers to prosecute it.
Danlami contended that the law allowed proescutors to reduce a complaint of an alleged offence into a First Information Report (FIR) before a magistrate.[pro_ad_display_adzone id=”70560″]
He also reminded the court that he was only holding brief for one Chinedu Ogoba of the Ministry of Justice.
In his ruling, the Judge, Malam Gambo Garba, adjourned the case till Jan. 20.
Garba ordered the prosecution to inform the substantive prosecutor to come before the court on the same date to take over his case.(NAN)
