Abuja – A Kubwa Grade 1 Area Court, Abuja, on Monday struck out a N1.1million land fraud case, filed against three men- Nnamdi Nkwocha, Hamza Abdullahi, and Robinson Ngwayi, for lack of diligent prosecution.
The judge, Mohammed Marafa, said whenever the complainant, Tochukwu Raymond, and the prosecutor, Eghwere Osiaje, wer ready for the case, they could come back to court.
The defendants’ counsel, Moses Ugwummadu, had told the court that the complainant and the prosecutor had stopped coming to court.
He also said that Nkwocha had paid the complainant 90 per cent of the said sum.
Ugwummadu prayed the court to strike out the matter as the complainant and prosecutor were not ready for the case.
Nkwocha, Abdullahi and Ugwayi of Kubwa, Abuja, were docked on charges of joint act, criminal breach of trust, cheating and forgery, offences they denied committing.
The News Agency of Nigeria (NAN) recalls that the complainant reported the matter at the Area Command, Kubwa, Abuja, on Nov. 8, 2014.
The defendants and one Sunny Gaza, now at large, conspired and sold a plot of land at Kubwa to Raymond for N1, 140, 000 and issued him a title document.
The said document was later discovered to be fake at the Bwari Area Council, Abuja.
The offences contravened Sections 96, 311, 312 and 363 of the Penal Code.
